Having cultural property a dual value, heritage and culture, will be the cultural interest which justifies that they have a legal protection that will allow government interference in the content of these property rights and will mean for the owners, holders and holders a number of obligations, burdens and limitations, which will have effects on both the joy and the power of available -circulation, exports of goods-with corresponding penalties for non-compliance-. There are also limits to the level of international law derived from jurisdiction and applicable law. In addition, interested in studying the situation in comparative law, to have a broader view of the issue and see what elements we can provide. Finally, there are other limits arising from taxation and intellectual property law to be taken into account. All this influences undoubtedly in the art market.La Ley del Patrimonio Histórico Español se configura como una excepción a la normativa civil en la que se establecen tanto la facultad de disponer libremente de la cosa a favor de otro -art. 348 Cc-, como las normas de seguridad del tráfico jurídico en relación a la adquisición del dominio mediante la buena fe y usucapión -arts. 1.473 y 464 Cc.- Al tener los bienes culturales un doble valor, patrimonial y cultural, será ese interés cultural el que justifique que los mismos tengan una protección jurídica que va permitir la injerencia de la Administración en el contenido de estos derechos reales y va a suponer para los propietarios, poseedores y titulares una serie de obligaciones, cargas y limitaciones, que van a tener efectos tanto sobre el goce como sobre el poder de disposición -circulación, exportación de los bienes-, con sus correspondientes sanciones para el caso de incumplimiento. Existen también límites a nivel de derecho internacional derivados de la competencia judicial y el derecho aplicable. Además, interesa estudiar la situación en derecho comparado, para tener una visión más amplia del tema y ver qué elementos podemos aportar. Finalmente, existen otros límites derivados de la fiscalidad y de la ley de propiedad intelectual que hay que tener en cuenta.
