Sumario:Civil liability has always been subjecting the theoretical developments under the influence of industrial and social developments in different eras in the high school social studies textbook and educational era. Nowadays, as events become more complicated, foresight and prevention of damage have overtaken the retrospect and following the traditional rules of compensation. "Preventive civil liability" is among the new trends in the trajectory of development of civil liability. This new approach relies on "foresight" and "prevention" of the damage and preventive role of civil liability. Preventive civil liability can be justified with a number of legal principles in Islamic law. The roles of prevention, deterrence and compensation, which are among obvious symbols of preventive responsibility, are compatible with a lot of legal mechanisms in procedural and substantive laws of Iran. The foundations of this new approach are the new rules of civil liability in Western law. This study was conducted aimed at expressing the restorative and complementary roles of preventive civil responsibility with respect to compensatory civil liability by introducing and explaining the position of this new approach and its Islamic and common principles.
