Sumario:The Algerian legislator included according to Law 10-05 of 05/20/2005 related to civil law an amendment added under Article 140-repeated within the third section of it related to the responsibility of the producer, stating that the producer shall be responsible for the defect that afflicts his product, whether it is connected with the damaged-ones by a contract or not, Thus, the legislator has established a product liability system in line with global legal developments in the field of compensation for damages caused by defective products of various kinds in light of the openness of the market and freedom of foreign trade, which makes genetically modified products in the eyes of many legal researchers within this field, but the reality that has proven by this research suggests that they are substances that are not the same as defective products, but are defective products in nature in addition to being dangerous to human health and environment.
