This figure corresponds to one-third of the total Muslim population. Some of them are indigenous people, others are immigrants. Although the problems they have to solve vary, the problem of religious identity is common to all. The secular world view of host societies is particularly affecting young people’s view of Islam. In addition, conscious assimilation policies cause minorities to abandon their own traditions and adopt the lifestyle of the majority. Fiqh Al-Aqalliyat that institutionalized in the last quarter of last century, is a unique discipline interested in all the problems of Muslims living outside the Islamic country, especially assimilation. This discipline is a product of congresses and symposiums organized by official and informal institutions. Methodologically, it uses a selective ijtihad technique and develops legitimate alternatives to Harams. It benefits from the maqasid comment which is the assurance of the universality of Islam and applies to the legal rules (el-qawa’id al-kulliyyah) obtained through induction. It gives suggestions for which to prioritize by looking at the priority of religious norms. The main aim is to seek answers to the fiqh problems of the Muslim minority living with non-Muslim societies. In doing so, attracts attention to points separating Muslims from other nations. It emphasizes the difference of intercultural actions, discourses and ideals without leaving the Islamic heritage. The most important function of fiqh al-aqalliyat is also emerged here. Because separation and difference are indispensable elements of identity. Without the differences or the “we and the other” distinction, there would be no identityM.
