The methodology consisted in the survey of sources related to the history of archaeology, authorizing directives for the research, in addition to a broad analysis of the brazilian legislation. The results point to a distortion when discussing cultural policies for archa- eology, with the Union actively participating in the construction of laws, but historically delegating to third parties the management of archaeological assets.
