Sumario:This article aimed to analyze access to justice for the elderly population, as well as the social and political consequences of their non-participation in the democratic context. It was used methodologically the documentary analysis of the judicial processes that processed in the Forum of the Region of Viçosa / MG, begun in the year 2014. The results pointed to a wide flow of lawsuits in the scope of the right to health. It is also added that elderly people encountered difficulties regarding the implementation of public policies and, therefore, they resorted to a significant recourse to the judicial process as a way of seeing their rights claimed. In addition, the results also indicated a path taken from effectiveness to judicialization, namely in the scope of the right to health and in requests for hospitalization for treatment by chemical dependency.
