Sumario:The proof in penal articles seeks to show the factual truth regarding the crimes committed, by using all proof’s instruments legally prescreened, and grantee the penal judge independence of assessing the evidence presented in case’s file. According to the principle of judicial conviction based on the independence of proof. Hence the importance of our research’s subject, which will address the most important controls and restrictions mentioned by the legislator on the application of the principle of personal conviction of the criminal judge, which are the guarantees that ensure the protection of individuals rights and society alike in order to achieve the necessary balance between the two interests.
