Sumario: | Ahead of the complexity of the society contemporary, the traditional theoretical matrices of the Law reveal insufficient for a serious legal reflection. Among the several existing proposals, one that is more viable today is the reconstruction of legal theory from the systemics postulates. In this perspective, the risk and the paradox are essential elements for the understanding of the said society after modern. The security, postulate of modernity in the Law, opens space for the current and constant contingency of the present time. The Law cannot more have the simple pretension to move away the risks it must be a relief for the expectations. |
