Sumario: | The animal is protected by French criminal law against abuses and cruelty. To give effect to this protection, the Code of Criminal Procedure allows animal welfare associations to exercice civil action to defend the interests of animals victims of such offenses. This representation of individuals of an animal species before the judge ask about the defended interest : is it the interest of the animal that is represented for protection or rather one of its owner or even the general interest ? We find that there is now a form of indirect representation of the animal’s interest that remains relatively limited. For this representation becomes useful and effective, it should, however, that the interest of the animal can be defended directly before the Courts and that it is therefore granted legal status other than that to object of rights. |
