Theoretically, the work was based on organizational institutionalism and sociology of law. The first stage of the research qualitatively analyzed the regulatory framework relating to electronic procurement and the second stage quantitatively investigated the celerity of 184 bidding processes carried out by the Bank of Brazil in the first half of 2013, a decade after the Federal Act 10.520/02 has established the modality. Results showed the resonance between the discourse of the Federal Court of Auditors (TCU) and the administrative activity of the BB. Overall, the results indicated that the use of e-procurement showed no pattern of behavior that link celerity to the complexity or economy. Moreover, discourse of TCU is built in order to connote the use of e-procurement as desirable practice, even when legal obligations are not prescribed.
