Summary:The article deals with the contours of the criminal law of “treatment” based on the medical-psychiatric discourse, seeking to analyze the consequences of the (criminal) reaction to the “dangerous” and potentially criminal subject, as well as the inheritance of this dangerousness in the Brazilian Criminal Justice System. In this way, it problematizes the penal-psychiatric state that comes to connect the notion of “disease” and “danger” as justification for denial and annihilation of the human being.
