Sumario:This article tries to get closer to the historiographical and juridic investigation over the file that contains the “residencia trial” suited by don Tiburcio de Espinoza y Losada vs the Corregidor don Luis García de Ocampo circa 1667 in Trujillo, Peru,  about the judicial error or mistake in the judgement of an inheritance and guardianship. The author tries to show a general perspective of the application of surveillance politics of the Spanish Empire over his deputies in South America and Peru at that ages and, by the way, particularly, analize the judicial file from the view of the different behaviors of the persons inmmerse in this inusual trial.
